Terms of Service

1. Acceptance of Terms

By accessing or using SINK ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

SINK is a time-coded social layer for movies and TV shows. We provide:

  • Time-coded comment feeds synchronized to content
  • Watch party rooms (public and private)
  • Moments and highlights discovery
  • Match/voting features
  • Audio synchronization tools

Important: SINK does not play, host, or redistribute video content. Users watch content on their own streaming services (Netflix, Disney+, etc.).

3. User Accounts

  • You must be at least 13 years old to use the Service
  • You are responsible for maintaining the security of your account
  • You must provide accurate and complete information
  • One person or entity may maintain only one account
  • You are responsible for all activities under your account

4. Content Policy

4.1 Prohibited Content

You agree not to post, upload, or share content that:

  • Is illegal, harmful, or violates any laws
  • Contains harassment, hate speech, or threats
  • Is spam, misleading, or fraudulent
  • Infringes on intellectual property rights
  • Contains personal information of others without consent
  • Is sexually explicit or contains adult content
  • Promotes self-harm or violence

4.2 User-Generated Content

  • You retain ownership of content you post
  • You grant us a license to use, display, and distribute your content on the Service
  • You represent that you have the right to post the content
  • We reserve the right to remove content that violates these Terms

4.3 Moderation

All content is subject to automated and manual moderation. We may:

  • Review content before it appears publicly
  • Remove or hide content that violates our policies
  • Suspend or ban accounts that repeatedly violate Terms
  • Report illegal content to law enforcement

5. Repeat Infringer Policy

In accordance with the Digital Millennium Copyright Act (DMCA), we maintain a repeat infringer policy:

  • Users who receive 3 or more valid copyright infringement notices will be permanently banned
  • Strikes are tracked per user account
  • Strikes may also result from violations of our content policy
  • Banned users may not create new accounts
  • Appeals may be submitted to appeals@sink.chat

6. Premium Subscriptions and Payments

6.1 Subscriptions

  • Plus ($4.99/month): Private rooms, Replay, highlight credits
  • Pro ($14.99/month): Unlimited private rooms, BYO Audio, Broadcast tools
  • Subscriptions auto-renew unless canceled
  • You can cancel anytime in Settings or via Stripe Customer Portal

6.2 Highlights

  • Highlights are consumable purchases ($0.99-$1.99)
  • All sales are final except for technical failures
  • Refunds may be issued at our discretion for technical issues
  • Paid highlights may be removed if they violate our content policy (no refund)

6.3 Refunds

Subscription refunds are handled according to App Store and Google Play policies. For web purchases, contact support@sink.chat within 14 days of purchase.

7. Intellectual Property

  • The Service and its original content are owned by SINK
  • You may not copy, modify, or distribute our content without permission
  • We use third-party services (TMDB, OpenSubtitles) under their respective licenses
  • See our Attribution page for details

8. Account Deletion

You may delete your account at any time in Settings. Upon deletion:

  • Your account and profile will be permanently removed
  • Your comments may be anonymized or removed
  • Active subscriptions will be canceled
  • Data will be deleted according to our retention policy (see Privacy Policy)
  • This action cannot be undone

9. Disclaimers

  • The Service is provided "as is" without warranties
  • We do not guarantee uninterrupted or error-free service
  • Sync accuracy may vary based on audio quality and content
  • We are not responsible for content posted by users
  • We do not endorse or verify user-generated content

10. Limitation of Liability

To the maximum extent permitted by law, SINK shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
